Welcome to Claims App. These Terms of Service (“Terms”) form a legally binding agreement between you and Claims App LLC (“Claims App,” “we,” “our,” or “us”) governing your access and use of all services provided through our mobile application, website (https://claims.so), backend dashboard, email alerts, and any related tools or features (collectively, the “Services”).

By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you may not access or use our Services.

2. Eligibility and Scope

You must be at least 18 years old and reside in a jurisdiction where our Services are permitted. If you are accessing the Services on behalf of a business or organization, you confirm that you have the authority to bind that entity to these Terms.

We may limit access to users, jurisdictions, or platforms at our sole discretion.

3. Description of the Service

Claims App helps users discover, track, and submit class action and consumer settlement claims. Our app:

• Identifies eligible settlements based on user responses

• Collects relevant data via in-app forms

• Sends reminders and claim updates

• Stores historical user claim data securely

• Submits forms manually or semi-automatically based on user consent

We are not a law firm and do not offer legal advice. Claim outcomes are determined by third-party settlement administrators.

4. Account Registration and Data Collection

We collect user data via our app and store it securely. This includes:

• Email address and name

• Location, demographics, device information

• Responses to in-app questions or surveys

• Claim submission history and preferences

Your information is used solely for claim matching, submission, analytics, and notification purposes. All data is stored securely using Supabase and encrypted in accordance with industry standards.

We may create accounts for users manually through internal dashboards for privacy and security purposes.

5. Notifications and Permissions

By using our Services, you agree to receive:

• Push notifications (enabled at onboarding)

• Email alerts related to your claims

• Updates on settlements you may qualify for

You may opt out of communications via app settings at any time.

6. License and Use Rights

We grant you a limited, non-transferable, non-exclusive license to use the Services for personal use. You agree not to:

• Reverse engineer, copy, resell, or misuse the platform

• Submit false or fraudulent claims

• Interfere with or bypass our security systems

Violations may result in legal action or account suspension.

7. Limitations of Liability

We do not guarantee eligibility or payout for any settlement. Final determinations are made by third-party administrators. Claims App is not liable for:

• Denied claims

• Missed deadlines

• Errors in submitted information

To the fullest extent allowed by law, our liability will not exceed $100 in aggregate.

8. Legal Disclaimers

Claims App provides information and automation but not legal services. We make no representations or warranties, express or implied, about the success or outcome of any claim.

9. Termination

We reserve the right to suspend or terminate your account for violations of these Terms. You may delete your account at any time by contacting support.

10. Changes to the Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes your acceptance. The latest version will always be available at https://claims.so/terms.

11. Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles. All disputes shall be resolved in the state or federal courts located in Bernalillo County, NM.
